California Privacy Notice

Knix Wear, Inc. (referred to herein as “we,” “us,” or “our”) provides this privacy notice for residents of the State of California pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”).  The CCPA and CPRA require that we inform California residents about our collection and processing of personal information and the rights of California residents with respect to their personal information. This privacy notice supplements our Privacy Policy.

For clarity, this privacy notice applies to personal information we collect from and about California residents in any form or manner, including online through our websites, mobile applications, and online services and offline, such as in our physical retail stores, electronically, in writing, or over the phone. This privacy notice does not apply to employment-related personal information we collect from California residents.


Collection and Disclosure

The table below identifies the categories of personal information we may collect from or about California residents, the purposes for which we collect and use each category of personal information, and whether such personal information is sold or shared. For purposes of this privacy notice, “sold’’ means selling, renting, releasing, disclosing, disseminating, making available, transferring, or communicating a consumer’s personal information to a third party for monetary or other valuable consideration, and “shared” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or communicating a consumer’s personal information to a third party for cross-context behavioral advertising. We do not knowingly sell or share personal information collected from consumers who are under the age of 16.

This list is in addition to the categories of personal information and purposes described in our Privacy Policy.

We retain information collected for as long as necessary to fulfill the purposes for which the information is collected, as required or permitted by law, or for other legitimate purposes such as disaster recovery, resolving disputes, and enforcing our agreements.

“Sales” of Personal Information

Depending on the relationship we have with you, we may disclose the following categories of personal information in ways that could be deemed a “sale” for purposes of the CCPA and CPRA: (i) Identifiers; (ii) Categories of personal information described in Cal. Civ. Code Section 1798.80(e); (iii) Commercial information; (iv) Geolocation data; and (v) Professional or employment-related information. We do not sell (i) Audio, electronic, visual, thermal, olfactory or similar information; (ii) Characteristics of Protected Classifications under California or Federal Law; (iii) Inferences drawn from personal information; (iv) Internet or other network activity; or (v) Sensitive Personal Information.

“Sharing” of Personal Information for Cross-Context Behavioral Advertising

Depending on the relationship we have with you, we may “share” the following categories of personal information for purposes of cross-context behavioral advertising: (i) Identifiers; (ii) Categories of personal information described in Cal. Civ. Code Section 1798.80(e); (iii) Geolocation data; (iv) Internet or other network activity; and (v) Inferences drawn from this information. We do not “share” (i) Audio, electronic, visual, thermal, olfactory or similar information; (ii) Characteristics of Protected Classifications under California or Federal Law for such purposes; (iii) Commercial Information; (iv) Professional or employment-related information or (v) Sensitive Personal Information.

During the preceding 12-month period, we may have:

California Consumer Privacy Rights

California laws provide residents with certain rights with regard to their personal information, subject to some exceptions. If you are a California resident, we have summarized your rights below and how you can exercise them.

Right to Access Personal Information:

You have the right to request, twice in a 12-month period, the following information about the personal information we have collected about you during the past 12 months:

  1. the categories and specific pieces of personal information we have collected about you;
  2. the categories of sources from which we collected the personal information;
  3. the business or commercial purpose for which we collected or sold the personal information;
  4. the categories of third parties with whom we shared the personal information; and
  5. the categories of personal information about you that we sold or disclosed for a business purpose, and the categories of third parties to whom we sold that information or disclosed it for a business purpose.

You also have the right to opt-out of the “sharing” of your personal information for cross-context behavioral advertising. You can exercise this right by accessing our preferences tool.

We also rely on a third-party service provider to implement a tool in an effort to recognize and honor “do not track” and Global Privacy Control signals as requests to opt-out of “sharing” your personal information for cross-context behavioral advertising purposes.

Right to Limit Use or Disclosure of Sensitive Personal Information

You have the right to limit our use or disclosure of your sensitive personal information for purposes other than the following:

  • To perform services or provide goods that you reasonably expect;
  • To detect security incidents that compromise sensitive personal information;
  • To resist malicious, deceptive, fraudulent, or illegal actions and prosecute those responsible;
  • To ensure physical safety of natural persons;
  • For short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your interaction with our websites, mobile apps, and other online services;
  • To perform services on our behalf, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders/transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services;
  • To comply with laws, rules, or regulations or to comply with legal process; and
  • To verify, maintain, or enhance a service or device that we own, manufacture, or control.

We do not use or disclose sensitive personal information except for the permitted purposes described above.

 

We only respond to requests to know, access specific pieces of personal information we have about you, delete personal information, and correct inaccurate personal information when we can verify that you are a California resident exercising your rights regarding your personal information. You can designate an authorized agent to make a request on your behalf by providing the agent with power of attorney.  We may require the authorized agent to provide proof that you gave the agent signed permission to submit the request, as well as verification of your identity or confirmation that you have duly authorized the agent permission to submit the request. 

We do not discriminate against California residents who exercise any of their rights described in this privacy notice.

To help protect your privacy and maintain security, we take steps to verify your identity before granting access to information or complying with a request. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

Under California Civil Code Section 1798.83, California residents have a right to request, once per year and free of charge, information about the categories of personal information (if any) we have disclosed to third parties for their direct marketing purposes during the previous calendar year. If you are a California resident and would like to make such a request, please send an email to privacy@knix.com with the subject line “California Shine the Light Request.”

Notice of Financial Incentive

We offer our customers, including California consumers. various types of financial incentives, such as coupons and discounts when the sign up to receive our marketing emails, refer a friend, or join our loyalty program that provides certain rewards and offers (each, a “Program” and collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law. The value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants. You may opt into a Program by following the sign up or participation instructions provided, and you may withdraw from participating in a Program at any time by unsubscribing to our emails, closing your loyalty account, or contacting us.
